Terms & Conditions

Please read these Terms carefully before using the Padosi Mart mobile application ("App") or website. By creating an account or using any part of the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. About Padosi Mart

Padosi Mart is a community marketplace platform that enables residents of apartment communities ("Community") to buy from and sell to their neighbours. We provide the technology platform; we are not a party to transactions between buyers and sellers.

2. Eligibility

• You must be at least 18 years old to create an account.
• You must be a resident of a registered Community to access stores within that Community.
• You must provide accurate and current information during registration.

3. Accounts

• You are responsible for maintaining the security of your account.
• You must not share your account credentials or allow others to access your account.
• You are responsible for all activity that occurs under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Buyers – Placing Orders

• When you place an order, you enter into a direct agreement with the seller, not with Padosi Mart.
• You agree to provide a valid delivery address (flat number) and to be available to receive your order.
• Orders may be cancelled by the seller if items are unavailable.
• All payments are made directly between buyer and seller as agreed at the time of ordering. Padosi Mart does not currently process or hold payments.
• Disputes regarding product quality or delivery must be resolved directly with the seller. Padosi Mart may assist in mediation but is not liable for the outcome.

5. Sellers – Running a Store

• Any Community resident may apply to open a store. Stores must be approved by a Community admin before going live.
• You are solely responsible for the accuracy of your product listings, including descriptions, prices, and availability.
• You must only list items that are legal to sell in India and comply with all applicable laws and regulations.
• You must fulfil orders you accept in a timely manner.
• You must not list counterfeit, expired, hazardous, or prohibited products.
• Padosi Mart reserves the right to remove listings or suspend stores that violate these Terms.

6. Prohibited Conduct

You must not:

• Use the App for any unlawful purpose.
• Post false, misleading, or fraudulent content.
• Harass, threaten, or abuse other users.
• Attempt to gain unauthorised access to any part of the App or other users' accounts.
• Use automated tools (bots, scrapers) to access the App.
• Engage in any activity that disrupts or interferes with the App's operation.

7. Intellectual Property

The Padosi Mart name, logo, and App design are our intellectual property. You may not copy, modify, or distribute them without our prior written consent.

Content you create (store listings, product descriptions, photos) remains yours. By posting it on Padosi Mart, you grant us a non-exclusive licence to display it within the App for the purpose of operating the marketplace.

8. Disclaimers

• The App is provided on an "as is" and "as available" basis without warranties of any kind.
• We do not guarantee the quality, safety, legality, or availability of any product listed by sellers.
• We are not liable for any loss or damage arising from transactions between buyers and sellers.
• We do not guarantee uninterrupted or error-free operation of the App.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Padosi Mart shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of, or inability to use, the App.

10. Indemnification

You agree to indemnify and hold harmless Padosi Mart and its team from any claims, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or your violation of these Terms.

11. Termination

We may suspend or terminate your account at any time, with or without notice, if you breach these Terms or if we decide to discontinue the App. You may delete your account at any time via Profile → Delete Account in the App.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. We will notify you of material changes via the App or email.
